Job Description for Compliance Specialist:
- Regulatory Adherence and Monitoring:
- Monitor and enforce compliance with all applicable labour laws and regulations, including the Factories Act (if applicable), Shops & Establishments Act, Payment of Wages Act, Minimum Wages Act, Payment of Bonus Act, Equal Remuneration Act, and the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act (POSH Act).
- Stay abreast of dynamic regulatory changes and new Labour Codes in India, analyzing their impact on company policies and operations, and communicating implications to management.
- Statutory Filings and Documentation:
- Manage and oversee all statutory registrations, licenses, and their timely renewals.
- Ensure accurate and timely submission of all statutory filings, periodic returns, and compliance reports to relevant government authorities (e.g., PF, ESIC, PT, LWF).
- Maintain comprehensive and up-to-date documentation, including statutory registers, records of wages, attendance, leave, and other relevant data, to ensure transparency during inspections.
- Audits and Risk Management:
- Plan and conduct regular internal compliance audits and risk assessments to identify potential vulnerabilities, compliance gaps, and operational inefficiencies.
- Develop and implement corrective action plans and process improvements to address audit findings and mitigate identified risks.
- Coordinate and facilitate external audits and government inspections, acting as the primary liaison with authorities such as the Labour Department, PF/ESIC officials, and other relevant bodies.
- Policy Development and Training:
- Draft, revise, and implement company-wide policies and standard operating procedures (SOPs) to ensure alignment with current legal requirements and best practices.
- Develop and deliver compliance training sessions and awareness programs for employees and management on regulatory requirements and internal policies.
- Liaison and Grievance Handling:
- Serve as the primary contact person for government authorities and external legal consultants on labour compliance matters.
- Collaborate with the HR and Finance departments to ensure seamless execution of compliance-related activities, such as payroll deductions and employee benefits administration.
- Assist in managing and handling employee grievances related to compliance issues, ensuring fair and timely resolution.
Required Qualifications & Skills:
- Education: Bachelor’s degree in law, Human Resources, Business Administration, or a related field. A master’s degree or relevant professional certifications (e.g., Certified Compliance and Ethics Professional - CCEP) are a plus.
- Experience:
- Proven experience (3-6 years suggested) in a compliance, legal, or HR role with a focus on Indian labour laws.
- Demonstrable experience in managing end-to-end statutory documentation and filings (PF, ESIC, PT, LWF, etc.).
- Experience working within the IT/ITES industry is preferred.
- Skills:
- In-depth knowledge of Indian labour legislation and regulatory frameworks.
- Excellent analytical, research, and problem-solving abilities.
- Strong written and verbal communication skills, with the ability to interpret complex regulations and explain them clearly.
- High ethical standards, integrity, and discretion when handling confidential information.
- Proficiency in MS Office and familiarity with compliance management software or tools is advantageous.
